doing business in more than one state
When you do business in more than one state, each state wants a piece of the action, meaning you need to split up your income and file a tax return for each state. But determining what exactly qualifies as “doing business” in a state can be tricky.
- If you have a physical location, like an office or store in a state, you are doing business there.
- If you provide services in a state, like construction or consulting you are doing business there.
- If you have employees working in a state, you are doing business there. (But working there for how long? – a day – a week – a month?)

Whenever you do business out of state, you must register as a “foreign entity”. Pay attention because in some states there are a lot of requirements, including some at the county and city level.
